Terms and Conditions for the Fund Transfer

Article 1 — Scope of Application

These Terms apply to the fund transfer service provided by Forex Japan Co., Ltd. Members agree that this service is provided under the Act on the Settlement of Funds (ASF) and is not a bank currency exchange, deposit, savings, or time deposit. The service is not covered by deposit insurance schemes.

Users are protected by the Performance Security Deposit Scheme pursuant to Article 43 of the ASF; Forex Japan lodges the requisite security deposit with the Tokyo Bureau of Legal Affairs.

Article 1-2 — Unauthorized Transactions

Losses caused by instructions from unauthorized persons given against the member’s will are not compensated under this service.

Article 2 — Use of Service

To use the service, applicants must complete registration and become overseas remittance transaction members under company provisions.

Article 3 — Registration

Applicants agree to these Terms and other regulations established by the company and apply by methods prescribed by the company.

Article 4 — Identity Verification

Forex Japan verifies identity in accordance with the Act on Prevention of Transfer of Criminal Proceeds, the Foreign Exchange and Foreign Trade Law, related regulations, and administrative guidance.

Article 6 — Handling of Customer Information

Personal and transaction information may be shared with the company’s branch, subsidiary, affiliates, agents, financial institutions, and outsourcers (including overseas) to the extent necessary for storage, management, and execution of related business.

Article 10 — Request for Remittance

Applications may be made by visiting the office directly, sending by facsimile to designated numbers, or calling designated phone numbers.

Article 15 — Fees and Expenses

Remittance fees are charged as prescribed by the company. Fees may also be charged for inquiries, changes, and reversals.

Article 22 — Limitation of Liability

Any damages owed by the company in connection with the service are limited to the amount of the remittance.

Article 29 — Governing Law and Jurisdiction

These Terms are governed by Japanese laws and regulations. The Tokyo District Court has exclusive jurisdiction for disputes at the first instance. In case of discrepancies, the Japanese version prevails.

Article 31 — Changes

The company may change these Terms for reasonable reasons (including changes in financial circumstances) and will display the effective date appropriately.
